Grace period

A grace period is the time after a premium due date, or after a notice of cancellation for nonpayment, during which the insured can still pay and keep the policy in force; its length is set by the policy and by state law, and differs by state and line.

What it means

Grace periods are a creature of statute and contract, not a single industry number. In New York, for example, the Department of Financial Services wrote in OGC Opinion No. 01-01-07 on auto policies: “Under N.Y. Ins. Law §3425(a)(10)(McKinney 2000), there is a fifteen-day ‘grace period’ during which the insured may pay the premium.” Other states, lines and carriers use different periods.

How it works: an installment is missed. The carrier sends a cancellation notice with a date. If payment arrives before that date, the policy continues; if not, it cancels, and some carriers offer reinstatement on late payment. Premium-financed policies follow the finance agreement’s own notice steps.

Why it matters for agency commissions

On direct bill business paid as collected, nothing is paid on an installment until it is collected, so a payment in the grace period shows up as a late commission line rather than a missing one. On business paid on written premium, a policy that cancels after the grace period produces a chargeback. Either way, a month in grace makes a statement look short when it isn’t yet.

How it shows on a commission statement

Look for an installment commission line that arrives a statement later than usual, or a cancellation line followed by a reinstatement line on the same policy. A policy in its grace period at month end often has no line that month at all.

Common mistakes to check

  • Flagging a policy in its grace period as unpaid commission before the period ends.
  • Assuming one grace period applies to every state, line and carrier.
  • Missing the reversal of a chargeback when a policy was paid inside the grace period.

Questions

What is a grace period in insurance?

The time after a missed payment or a nonpayment notice during which the insured can still pay and keep the policy in force.

How long is the grace period on car insurance?

It depends on the state, the policy and the carrier. In New York, the Department of Financial Services describes a fifteen-day grace period for auto policies under state law.

Is coverage in force during the grace period?

Generally yes, until the cancellation date in the notice; if payment is not made by then, the policy cancels as of that date.
