# Captive vs. independent agent

A captive agent sells for one insurer or group, which typically controls the products and often the book. An independent agent is appointed with several carriers and typically owns its expirations. That difference shapes commission: an independent agency gets a separate statement from each carrier, in a different format, and must reconcile all of them.

## What it means

The NAIC’s [glossary of insurance terms](https://content.naic.org/glossary-insurance-terms) defines a captive agent as “an individual who sells or services insurance contracts for a specific insurer or fleet of insurers,” and an independent agent as “a representative of multiple insurance companies who sells and services policies for records which they own and operate under the American Agency System.”

How it works: a captive agent signs with one company, sells its products and is paid under its single commission schedule. An independent agency holds [appointments](https://getlapidar.com/glossary/carrier-appointment/) with many carriers, quotes across them and owns the expirations. Ownership of the book, who can move clients and what happens to renewal commission when the relationship ends are set by each contract.

## How it shows on a commission statement

A captive agent typically gets one statement, from one system, with one layout. An independent agency gets one per carrier per month, plus wholesaler and network statements, each with its own codes, columns and timing. Reconciling them against the agency management system is where missing, short and duplicate commission hides.

## Example

**Example data: invented monthly statement load for two kinds of agency.**

| Agency | Carriers | Statements a month | Formats |
| --- | --- | --- | --- |
| Captive agent | 1 | 1 | 1 |
| Independent agency | 9 | 11 | 7 |

The independent agency’s eleven statements include two wholesalers. Each needs matching to the same book, by policy number, in its own format.

## Commonly confused

- An **insurance broker** is described as working on behalf of the customer; many independent agents are legally agents of their carriers. See [insurance agent vs. broker](https://getlapidar.com/glossary/insurance-agent-vs-broker/).
- **Exclusive agent** is often used for captive agents, especially those who are contractors rather than employees.
- Owning the **book of business** is a feature of the independent model, but the details are in each contract. See [book of business](https://getlapidar.com/glossary/book-of-business/).

## Common mistakes to check

- Assuming a captive contract lets the agent take clients or renewal commission when leaving.
- Reconciling each carrier’s statement in isolation instead of against one book.
- Treating every carrier’s commission schedule as the same because the line of business is the same.

## Questions

### Do captive agents or independent agents earn more commission?

There is no single answer. Rates, renewal commission, bonuses, expenses and book ownership all differ by contract. Compare the specific agreements, not the labels.

### Can a captive agent become independent?

Yes, many do, by getting appointed with several carriers. Whether existing clients and renewal commission come along depends on the captive contract.
