# Binding authority

Binding authority is the power a carrier gives an agency, in the agency agreement and underwriting guidelines, to commit the carrier to coverage, usually through a binder, without waiting for an underwriter, within set lines, limits and classes of risk.

By Lapidar, the team building it · October 14, 2026 · Also called authority to bind; underwriting authority (when held by an MGA)

## What it means

Authority is granted, and limited, by the carrier. A [Big “I” review of a Utica National agreement](https://www.independentagent.com/wp-content/uploads/2021/10/Utica-Agency-Agreement-Review-January-2022-October-2021.pdf) quotes the company’s right to withdraw it: the company “reserves the right to withdraw authority from the Agent to write any particular line of insurance and to decline or accept a risk or class of risk without previous notice.” Wider authority sits with a [managing general agent](https://getlapidar.com/glossary/managing-general-agent/), which, as IA Magazine puts it in [its guide to working with MGAs](https://www.iamagazine.com/2026/06/01/what-agents-should-look-for-when-partnering-with-mgas-on-new-insurance-programs/), “operates within underwriting authority granted by a carrier to design, underwrite, price, bind and administer coverage within a specific niche or segments of business.”

What it means for commission: business bound under the agency’s authority is usually on the agency’s code from day one, and the [binder](https://getlapidar.com/glossary/insurance-binder/) date is often the transaction date the commission line will carry. Binding outside authority is a classic [errors and omissions](https://getlapidar.com/glossary/errors-and-omissions-insurance/) exposure, and a policy the carrier later declines produces a flat cancellation and a full chargeback of any commission paid.

## How it shows on a commission statement

Bound business can appear on a statement before the policy is issued, at the binder premium, then again as an adjustment when the final premium is set. A bound risk that the carrier declines shows up as a reversal of the whole commission.

### In reconciliation, and what Lapidar does

Lapidar does not know what you are authorized to bind. It checks the commission on each statement line against your book and schedule, and pairs any reversal, such as a flat cancellation after a declined binder, with the original payment.

## Example

A binder that did not stick · EX-90377Example data

**Bound by the agency, annual premium**
$3,200.00

**Commission paid on the binder, 12%**
$384.00

**Carrier declines the risk; flat cancellation**
−$3,200.00

**Commission charged back**
−$384.00

Example data. Commission rates on this page are invented; your agency agreement and commission schedule set the real ones.

## Common mistakes to check

- Binding a class or limit outside the written authority because a similar risk was accepted before.
- Losing track of when authority for a line was withdrawn.
- Booking commission on a binder as final before the carrier has accepted the risk.

## Questions

### Do independent agents have binding authority?

Many do, within limits set by each carrier in the agency agreement and underwriting guidelines. Authority differs by carrier, line, limit and class.

### What is the difference between binding authority and an MGA’s authority?

An agency usually binds within narrow rules for the carrier. An MGA holds wider underwriting authority, often to price and issue policies in a niche.

### Can a carrier take binding authority away?

Yes. Agreements commonly let the carrier withdraw authority for a line; the Big “I” suggests agents ask for prior written notice.

### Who pays commission on a bound policy that is later cancelled?

The carrier usually charges back the commission paid, in full on a flat cancellation.
